Prime Minister Meloni said that the European Court of Justice's decision on safe countries of origin for illegal migrants is surprising.

She stated that the court decided to hand over the decision-making power regarding the return and deportation of illegal migrants to national judges, rather than evaluating individual cases.

“Thus, for example, in determining so-called safe countries, a national judge’s decision based on private sources takes precedence over the results of complex investigations carried out by the relevant ministries and evaluated by the sovereign Parliament. This development should worry everyone, including the political forces that welcomed the decision, as it further narrows the already limited scope of governments and parliaments to regulate and manage migration.”

Meloni added that the court’s decision weakens the policies aimed at combating mass illegal migration and protecting national borders.
